Caleb Thomas Schwab, son of Republican state representative Scott Schwab, died on the 168 foot high attraction at Schlitterbahn Waterpark in Kansas City in August.
Horrified witnesses reported that his body was slung from the Verruckt slide, translating to "insane" in German, while a lifeguard tried to hold the crowds back.

Following the fatal incident, some park guests have claimed that the slide's harness was not working properly earlier in the day.

Schlitterbahn Waterparks and Resorts said in a statement on Tuesday that the Verruckt will be permanently removed after a probe into the theme park tragedy is completed.

"In our opinion, it is the only proper course of action following this tragedy. All of us at Schlitterbahn have been heartbroken over the tragedy that occurred on Verruckt," they said.

Two other riders , both women, were seriously injured during the accident.

Hannah Barnes and Matraca Baetz described the incident as "the worst day of our lives".

Lawyers for Caleb and the women are independently investigating claims the slide had not been inspected by the state since opening two years ago.

But no charges or lawsuits have yet been filed.

Schlitterbahn Waterparks and Resorts said it has been co-operating with investigators and the victims' families and lawyers, noting that "the safety of our staff and our guests is our top priority".

"In our 50 years of providing an environment for families and friends to gather, we've never experienced this kind of devastating event."
